  • R. Gregory McDermott

Greg McDermott is a highly experienced litigator of insurance related matters. Early in his career he made his mark in cases like Lee v. Saliga, 373 S.E.2d 345 (W.Va. 1988), and Arbogast v. Nationwide Mut. Ins. Co., 427 S.E.2d 461 (W.Va. 1993), landmark cases in the areas of uninsured and underinsured motorists coverage. As well, McDermott gained extensive trial experience in personal injury litigation, mostly defending the interests of insureds of the world's largest insurers, but he also diversified his litigation experience by handling select cases on the plaintiffs' side. See, e.g., Estate of Postlewait v. Ohio Valley Med. Ctr., Inc., 591 S.E.2d 226 (W.Va. 2003).

As his career has matured, insurers have come to depend on McDermott to defend their interests in bad faith actions. McDermott has, in fact, become a frequent lecturer at seminars on insurance coverage and insurance bad faith litigation. As well, he has been hired on many occasions by both plaintiffs and defendants to offer expert witness analysis in significant insurance coverage and insurance bad faith cases. One such case, Kocher v. Oxford Life Ins. Co., 216 W.Va. 56, 602 S.E.2d 499 (W.Va. 2004), where McDermott served as an expert analyst on behalf of the plaintiff, resulted in a 39 Million Dollar verdict, and nationwide notoriety.

McDermott greatly enjoys using his litigation and insurance expertise as a mediator. He has successfully mediated settlements in more than one hundred cases, including several million dollar plus cases. In almost every civil claim for damages, insurance plays a key role. Therefore, the mediation process is greatly enhanced by a mediator with vast experience and knowledge in the area of insurance, claims adjustment and case evaluation. Greg stands out from other mediators in this important area, and it has made him an effective mediator. As well, the balance in his litigation practice between defense and plaintiff's work has established credibility with practitioners on each side, enhancing his ability to lead litigants to a middle ground in the mediation process.

McDermott makes his home in Wheeling, West Virginia, where he was born and raised. He comes from a family of lawyers. His father (Jim), brother (Patrick), uncle (Ron Johnson) and wife (Laurie) are all attorneys who practice with Greg at McDermott & Bonenberger. Greg and Laurie are the parents of two daughters, Morgan and Jackie, and are very active in community activities in the Wheeling area, where they serve as board members for several local organizations.
